By Jay Menon Source: Aerospace Daily & Defense Report (AW&ST) May 02, 2013 NEW DELHI — AgustaWestland is still in contention for two helicopter contracts in India, despite the bribery scandal surrounding its sale of AW101 helicopters to the Indian air force. The Anglo-Italian defense firm is bidding for a 56 Naval Utility Helicopters (NUH) contract and to supply 14 twin-engine helicopters to the Indian coast guard. Defense Minister A.K. Antony confirms the company is still in the running for both programs. “Since no decision to debar the company from participation in the procurement process has so far been taken, the bids are under process,” Antony says. India’s Central Bureau of Investigation (CBI) is investigating 13 people it suspects are involved in bribery surrounding the purchase of the VIP transport helicopters from the Finmeccanica subsidiary. India has suspended all payments and has threatened to cancel the purchase of the AW101 helos altogether if the charges of bribery to middlemen in India and abroad are proven. The NUH request for proposals (RFP) was issued in August 2012, before CBI’s inquiry into the VIP helicopter case. The RFP for the Indian coast guard helicopters was issued in November 2012. Two companies have bid for NUH, and three for the coast guard program. Meanwhile, AgustaWestland has formally requested the Indian defense ministry have bilateral discussions with the company on the VIP program, in response to Indian government maneuvering to cancel the deal. The Indian government had ordered the AW101s as part of a €560 million ($754 million) contract. The aircraft were to be used by the IAF Air Headquarters Communication Squadron for the VIP/head-of-state mission, replacing a small fleet of specially modified Mil Mi-8s. India has already received three of the helicopters; the remaining nine are due to be delivered by this year. According to a defense ministry official, 70% of the approximately $700 million due has been put on hold until the federal investigation report is final. But an AgustaWestland official says, “the deal is still active, as we haven’t received any communication from the Indian government regarding the cancelation of the contract.” Finmeccanica denies all wrongdoing, and investigations by both Italian and Indian authorities are continuing. The CBI’s probe should be completed in the coming months. The move follows the Feb. 12 arrest in Italy of Finmeccanica Chairman and CEO Giuseppe Orsi by investigators looking into whether AgustaWestland paid kickbacks worth around €50 million ($67 million) to secure the sale when Orsi was in charge of the company. A spokesperson with India’s Central Bureau of Investigation (CBI) tells Aviation Week that bribery charges have been registered in a special court against Gerhard Hoy, the representative in India of Rheinmetall, along with Indian businessman Abhishek Verma and his wife, Anca Neacsu. Verma allegedly took a bribe from RAD via Ganton Ltd., a company allegedly controlled by him, to stall the blacklisting procedures initiated by the Indian government, the CBI spokesperson says. Swiss-based RAD was one of six companies blacklisted by India’s defense ministry in March 2012 as a result of corruption allegations, forbidding them from doing business with India’s state-run Ordnance Factory Board (OFB) network for 10 years. RAD transferred $530,000 to a New York bank account belonging to Ganton Ltd, and Verma allegedly contacted the representatives of RAD and assured them that he would use his influence with Indian government officials to help stall the blacklisting procedures. RAD strongly denies the accusations of inappropriate business dealings with the Ganton group and Abhishek Verma. “Such allegations lack factual substance,” the company says in a statement. “Neither did the company collaborate with Ganton in order to prevent an RAD blacklisting in India through illegal means. To substantiate its position, RAD is committed to a close dialogue with Indian authorities and ready to cooperate with them.” RAD is equally determined to prove that earlier allegations that had led to the company’s blacklisting in March 2012 are false. The Swiss firm is challenging the order debarring it from doing business with OFB in the Delhi High Court. The CBI had recommended blacklisting RAD, as it had allegedly used corrupt and illegal means to try to win an OFB contract for a 35mm gun system in 2011. RAD also was one of the bidders for India’s requirement for a very short range air defense system. The five other entities barred from transacting business with the OFB for the next 10 years are Singapore Technologies Kinetics, Israel Military Industries, Russia’s Corporation Defense, TS Kisan and Co. India's comptroller and auditor general (CAG) has slammed the acquisition of 12 VVIP AgustaWestland AW101 helicopters for the Indian air force in its probe into the deal. According to the report, "the entire process of acquisition of VVIP helicopters right from framing of [the] Services Qualitative Requirements (SQRs) to the conclusion of contract deviated from laid down procedures. "The entire process of acquisition thus poses serious questions on accountability and lack of transparency in the finalisation of the contract, which need to be addressed." The report is likely to remove all hope of an early resolution to the matter. India's Central Bureau of Investigation (CBI) has already registered a case against 13 people and six firms with regard to the contract. A CBI investigation is under way and the contract has been put on hold. India has already paid about 30% of the €560 million ($737 million) contract. AgustaWestland was quick to issue a letter refuting the auditor's allegations. It says that change of the air force's requirements, stipulating a cabin height of 1.8m, was met by other helicopters and did not lead to the "ejection of any competing aircraft" from the contest. Focus was also placed on a change of the aircraft's service ceiling, dropping it to 4,500m (14,800ft) from 6,000m in an earlier request for proposals (RFP). AgustaWestland points to letters it sent to the Indian air force in 2005 stating that the AW101 could be modified to operate at the higher altitude. According to the CAG report, these changes "resulted in an operational disadvantage to the [air force]". The decision to make the minimum cabin height at 1.8m "essential" rather than "desirable" - from the 1.45m originally stipulated - reduced competition, resulting in a single vendor situation, it says. The report also questions the order for four additional helicopters, in view of the low utilisation rate - approximately 29% from 1999-2010 - of the existing fleet of VIP Mil Mi-8 helicopters. Uncertainty over the contract has led to AgustaWestland slowing down work on the order at its Yeovil, UK facility. Three AW101s are ready for delivery with the remainder of the order in an advanced state of completion. However, AgustaWestland remains hopeful these aircraft will eventually be handed over. Nonetheless, one of the completed AW101s, repainted in AgustaWestland livery, was transported to the recent MAKS air show in Russia. The Indian air force is already believed to be having trouble in keeping its fleet of three AW101s - delivered between November 2012 and February 2013 - airworthy. India had placed an order for 12 AW101 helicopters, eight in VIP configuration and four in non-VIP configuration. Alleged violations with respect to offset obligations as per the defence procurement procedure (DPP) were also mentioned in the report. The controversy means that the air force's Air HQ Communication Squadron, responsible for providing air transportation - rotary and fixed wing - to the country's president, vice-president and prime minister, will have to continue flying with its fleet of ageing eight Mi-8s, six of which were obtained in 1988. It is far from clear where the R-R situation is heading. Nonetheless, the news will serve to exacerbate concerns about the viability of New Delhi’s defence procurement processes, which are believed to suffer from a severe lack of transparency and accountability.
